These Terms & Conditions (the “Terms”) form a binding agreement between you and alphasmartchain.com (“we”, “us” or “the Company”). They govern your access to and use of our website, your member account and any investment, affiliate or related service we make available (together, the “Services”). Please read them carefully. By registering an account or using the Services you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy.

1. Eligibility

To use the Services you must:

• be at least 18 years old (or the age of majority where you live, if higher);
• have full legal capacity to enter into a binding agreement;
• not be located in, or a resident or citizen of, a country or territory where use of the Services would be unlawful or where we do not offer them; and
• not appear on any sanctions or restricted-persons list that applies to us.

You are responsible for making sure that your use of the Services is lawful where you live. We do not provide legal, tax or investment advice.

2. Your account

• You may hold one account only. Duplicate or shared accounts may be closed.
• You must give accurate, complete and current information when you register and keep it up to date.
• You are responsible for keeping your password, PIN and any two-factor authentication details confidential, and for all activity carried out under your account.
• Tell us immediately if you suspect that your account has been accessed without your permission. We are not liable for losses caused by your failure to protect your credentials.

3. Verification and compliance

To meet our legal obligations on anti-money-laundering, counter-terrorist financing and sanctions, we may ask you to provide proof of identity, proof of address, and information about the source of your funds at any time. We may delay, restrict or refuse any deposit, withdrawal or account until this information has been received and reviewed. We may also report suspicious activity to the relevant authorities, and we are not required to tell you when we do so.

4. Investments and returns

• Each investment package has its own description, minimum amount, term and projected return. Please read the details of a package before you invest.
• Any figure we show for returns, profit or yield is a projection or target, not a guarantee. Actual results may be lower than projected, and you may receive back less than you invested.
• Information on this website is provided for general information only. It is not personal advice, and it does not take your own objectives, finances or circumstances into account.
• You should make your own decision about whether an investment is right for you, and take independent professional advice if you are unsure.

5. Deposits

• Deposits can only be made with the payment methods shown in your account, and only from a wallet or account that is in your own name.
• Cryptocurrency transfers are irreversible. You are responsible for checking the address, network and amount before you send funds. Funds sent to the wrong address, on the wrong network, or in the wrong currency may be lost permanently and we cannot recover them.
• A deposit is credited once it has received the required number of network confirmations and, where applicable, has been reviewed by us.
• You confirm that the funds you deposit come from a lawful source and belong to you.

6. Withdrawals

• Withdrawals are paid to the wallet or account you have registered with us, in the currency in which they are made available.
• Requests are processed within a reasonable time after they are submitted and approved. Processing times can be longer when we need to carry out security or compliance checks, or when a payment network is congested.
• Funds committed to an investment package cannot be withdrawn before the end of that package’s term, unless the package’s own description says otherwise.
• We may set minimum and maximum withdrawal amounts, and we may decline a withdrawal request that we reasonably believe is fraudulent, unauthorised or in breach of these Terms.

7. Fees and taxes

Any fees that apply to a deposit, withdrawal or package are shown before you confirm the transaction. Network (“gas”) fees charged by blockchains or payment providers are outside our control and are paid by you. You are solely responsible for reporting and paying any tax that arises from your use of the Services; we do not withhold or pay tax on your behalf.

8. Affiliate programme

• Members may earn a commission by referring new members through their personal referral link, at the rates shown in the member area.
• Commission is paid only on genuine activity from real, separate people. Self-referral, fake or duplicate accounts, and referral activity that we judge to be artificial may lead to commission being withheld or reversed and the accounts being closed.
• You must not promote the Services with false or misleading claims, including any claim of guaranteed or risk-free returns, and you must follow all advertising and financial-promotion laws that apply to you.
• We may change or end the affiliate programme at any time. Changes do not affect commission already earned.

9. Acceptable use

You agree not to:

• use the Services for money laundering, fraud, terrorist financing, or any other unlawful purpose;
• provide false, stolen or misleading identity or payment information;
• attempt to gain unauthorised access to the website, other members’ accounts or our systems;
• use bots, scrapers, or any automated tool that interferes with the Services or places an unreasonable load on them;
• exploit errors, bugs or pricing mistakes for gain, or use any other form of manipulation or abuse; or
• use a VPN, proxy or other means to hide your location in order to get around geographic restrictions.

10. Risk disclosure

By using the Services you acknowledge that:

• investments, and in particular digital assets, commodities, real estate and other alternative assets, can be volatile and illiquid, and their value may fall sharply and quickly;
• regulatory, legal, tax and market changes can affect the value of an investment or our ability to provide a service; and
• technology risks such as outages, cyber-attacks, and software or network failures can cause delays .

11. Privacy and data protection

We collect and use personal information only as needed to run your account, carry out the checks described in section 3, provide support, and meet our legal duties. We take reasonable technical and organisational steps to protect your data, and we do not sell your personal information. We may share it with payment processors, identity-verification providers and public authorities where required to deliver the Services or by law. By using the Services you agree to this use of your information.

12. Intellectual property

The website, its design, text, graphics, logos and software belong to alphasmartchain.com or its licensors and are protected by intellectual-property laws. You may view and use the website for your personal use only. You may not copy, modify, distribute or create derivative works from any part of it without our prior written permission.

13. Limitation of liability

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law:

• we do not promise that the Services will be uninterrupted, secure, or free of errors;
• we are not liable for investment losses, lost profits, or loss of opportunity, or for any indirect, incidental or consequential loss;
• we are not liable for losses caused by events beyond our reasonable control, including network or blockchain failures, third-party outages, market disruption, government action, or natural events; and
• our total liability to you for any claim is limited to the amount you deposited in the 12 months before the claim arose.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud.

14. Suspension and termination

You can close your account at any time by contacting support, after any open investment has ended and any outstanding obligations are settled. We may suspend or close your account, or restrict access to some Services, if we reasonably believe you have breached these Terms, if we are required to by law or a regulator, or if we suspect fraud or misuse. Where it is lawful and practical to do so, we will return any funds that are properly yours after deducting amounts you owe us.

15. Changes to these Terms

We may update these Terms from time to time. When we make a material change we will post the new version here and change the “Last updated” date. If you keep using the Services after a change takes effect, you accept the updated Terms. If you do not agree with a change, you should stop using the Services and close your account.

16. Governing law and disputes

These Terms, and any dispute arising from them or from the Services, are governed by the laws of the jurisdiction in which alphasmartchain.com is established. Before starting any formal proceedings, you agree to contact us and try in good faith to resolve the matter informally for at least 30 days. If it cannot be resolved, it will be decided by the courts of that jurisdiction, unless mandatory consumer-protection law where you live gives you the right to bring a claim elsewhere.
